1. CORPORATE INFORMATION
The heismilano.com website (the "Platform") is operated by:

The intellectual property rights referred to in Section 2.1 are held by the holder of the above business.
The Platform is hosted by Shopify International Ltd., 2nd Floor, 1-2 Victoria Buildings, Haddington Road, Dublin 4, Ireland.
1.1. Complaints and out-of-court dispute resolution
Complaints may be addressed to clientservices@heismilano.com. Where a complaint concerning a purchase is not resolved, the Consumer may apply to the competent out-of-court dispute resolution bodies provided for by Italian law. Recourse to such bodies is voluntary and does not affect the right to bring proceedings before a court. Purchases made on the Platform are governed by the Terms and Conditions of Sale.
2. TERMS AND CONDITIONS OF USE OF THE PLATFORM
These Terms and Conditions of Use apply to the use of the Platform. HEIS may modify them at any time. The version published on this page applies to use of the Platform from the date of publication.
2.1. Intellectual property
HEIS is a registered trademark. The HEIS trademark, the designs of the items, the visual identity, the images, the texts and all other materials published on the Platform (the “Content”) are owned by HEIS, or used by HEIS under licence, and are protected by applicable laws on trademarks, copyright and design rights.
Technical solutions applied to HEIS items are the subject of filed patent applications.
Use of the Platform grants the user no right over the Content. Reproduction, modification, distribution and use of the Content for commercial purposes are not permitted without the prior written authorisation of HEIS.
2.2. Security of data transmission
HEIS adopts technical and organisational measures to protect the Platform. The transmission of information over the Internet is not, by its nature, immune from risk, and HEIS does not control the networks through which such transmission occurs.
This paragraph does not limit the liability of HEIS for its own conduct, nor the obligations of HEIS as data controller under Regulation (EU) 2016/679.
2.3. Availability of the Platform
The Platform is made available in the form in which it is published. HEIS does not undertake to ensure uninterrupted availability, and may suspend access for maintenance, security or technical reasons.
Within the limits permitted by law, HEIS is not liable for indirect or consequential damages, or for loss of profit, arising from the use of or the inability to access the Platform. This limitation does not apply in cases of wilful misconduct or gross negligence, in cases of death or personal injury, or where mandatory provisions of Italian law provide otherwise. The rights granted to the Consumer in connection with purchases made on the Platform remain unaffected and are set out in the Terms and Conditions of Sale.
2.4. Personal data
To access certain services, such as purchases and brand updates, the user provides personal data. Such data is processed in accordance with Regulation (EU) 2016/679 and Italian Legislative Decree 196/2003. Purposes, legal bases, retention periods and the rights of the data subject are set out in the Privacy Policy.
2.5. Cookies
The Platform uses technologies necessary for its operation and, subject to consent, analytics technologies. Disabling cookies at browser level may limit certain functionalities, including checkout. The categories in use and the management of consent are set out in the Cookie Policy.
2.6. Unsolicited submissions
HEIS does not accept unsolicited projects, sketches, designs or creative proposals, and does not review them.
Material of this nature sent to HEIS through the Platform or any other channel is not treated as confidential and does not give rise to any obligation on the part of HEIS, including any obligation of confidentiality, examination, response or remuneration. HEIS invites the user not to send such material.
Where HEIS wishes to examine a proposal, it does so on the basis of a written agreement signed in advance.
2.7. Links to third-party websites
The Platform may contain links to third-party websites. HEIS does not control such websites and is not responsible for their content, for the products or services offered, or for the personal data practices they adopt.
2.8. Liability of the user
The user is liable for damage caused to HEIS by use of the Platform in breach of these Terms and Conditions of Use or in breach of the law, in accordance with the ordinary rules on liability.
2.9. Applicable law and jurisdiction
These Terms and Conditions of Use are governed by Italian law.
For disputes concerning the use of the Platform, jurisdiction rests with the Court of Milan, Italy. Where the user is a Consumer, jurisdiction rests with the court of the Consumer's place of residence or domicile, and the mandatory consumer provisions of the law of the Consumer's State of habitual residence within the European Union remain unaffected.
The Italian version of this Legal Notice prevails.
